3.1 VoIP Packages and Hardware

We offer VoIP packages and hardware solutions tailored to client needs.
All hardware remains the property of BlackTieVoIP until fully paid.
Hardware warranties and support are subject to manufacturer terms and conditions.
Installation and configuration services are provided as specified; additional work may incur extra charges.

3.2 Web and Email Hosting

Hosting services are provided based on the selected plan.
We do not guarantee 100% uptime but will endeavor to maintain high availability.
Clients are responsible for maintaining the security of their login credentials and content.
We reserve the right to suspend or terminate hosting accounts for violations of these Terms or misuse.

3.3 Cloud Backups and Disaster Recovery Solutions

We offer cloud backup services to safeguard client data.
Clients are responsible for ensuring their data is correctly configured for backup.
We do not guarantee data recovery success in all circumstances; backups should be tested regularly.
Disaster recovery solutions are provided based on agreed Service Level Agreements (SLAs).

3.4 Cybersecurity Solutions

Our cybersecurity services include threat detection, prevention, and response.
Clients must cooperate with implementation requirements.
We do not guarantee immunity from all cyber threats but will take reasonable steps to secure systems.

3.5 IT Support (Remote and On-Premises)

Support services are provided remotely or on-site as per client agreements.
Support is subject to availability and may be limited outside normal business hours unless otherwise specified.
Clients shall provide necessary access and cooperation for effective service delivery.

4. Payment and Billing

All services and products are billed according to the applicable rates at the time of agreement.
Payments must be made promptly; failure to do so may result in suspension or termination of services.
Additional charges may apply for extra work outside the scope of initial agreements.

5. Customer Responsibilities

Clients shall provide accurate information and cooperate with us to facilitate service delivery.
Clients are responsible for maintaining the security of their accounts, devices, and content.
Clients must comply with all applicable laws and regulations.

6. Intellectual Property

All content, software, and materials provided remain the property of BlackTieVoIP or its licensors.
Clients are granted a limited license to use the services for their intended purpose.
Unauthorized use, copying, or distribution is prohibited.

7. Data Security and Privacy

We implement appropriate security measures but do not guarantee complete security.
Clients are responsible for securing their own systems and data.
Our Privacy Policy applies to all client data and can be reviewed here.

8. Limitation of Liability

BlackTieVoIP shall not be liable for damages arising from use or inability to use the services, including data loss or downtime.
We do not guarantee that services will be uninterrupted or error-free.
Clients are responsible for backing up their data.

9. Warranties and Disclaimers

Services are provided “as is” without warranties of any kind, express or implied.
Hardware warranties are subject to manufacturer terms.
We do not guarantee the effectiveness or security of cybersecurity or backup solutions.

10. Indemnity

You agree to indemnify and hold harmless BlackTieVoIP from any claims, damages, liabilities, costs, or expenses arising from your use of the services or breach of these Terms.

11. Termination

We reserve the right to suspend or terminate services for violations of these Terms or non-payment.
Clients may terminate services in accordance with their agreements. Early termination fees may apply.

12. Changes to Terms

We may update these Terms at any time. Changes become effective immediately upon posting. Continued use of services signifies acceptance of new terms.

13. Governing Law

These Terms shall be governed by and construed under the laws of South Africa.
